Donât Mess with Texas (or Florida)
This week, Texas and Florida showed up to the real estate party with flamethrowers.
Texas: Lawmakers there are gunning for NARâs hate speech policy (Standard of Practice 10-5). The proposed bill (SB 2713) would stop trade groups from denying membership based on someone exercising their First Amendment rightsâeven if that includes âcontroversialâ speech. Basically, Texas is saying: you canât get kicked out for what you post online, even if itâs spicy.
Translation: If youâre in real estate and posting questionable takes on Facebook, this bill could keep you in the club. Critics say it opens the door for discrimination; supporters call it a win for free speech.
Florida: Meanwhile, Florida is trying to hit the delete button on its Real Estate Commission (FREC) as part of a broader âgovernment efficiencyâ plan. The billâs passed the House, and if the Senate gives it a thumbs-up, FREC could be gone by July 1. Thatâs the body that educates and regulates agentsâso, yeah, kind of a big deal.
Whether either of these moves actually happens is TBD, but the message is clear: states are starting to flex hard on real estate regulation. Buckle up.
