Don’t Mess with Texas (or Florida)

This week, Texas and Florida showed up to the real estate party with flamethrowers.

Texas: Lawmakers there are gunning for NAR’s hate speech policy (Standard of Practice 10-5). The proposed bill (SB 2713) would stop trade groups from denying membership based on someone exercising their First Amendment rights—even if that includes “controversial” speech. Basically, Texas is saying: you can’t get kicked out for what you post online, even if it’s spicy.

Translation: If you’re in real estate and posting questionable takes on Facebook, this bill could keep you in the club. Critics say it opens the door for discrimination; supporters call it a win for free speech.

Florida: Meanwhile, Florida is trying to hit the delete button on its Real Estate Commission (FREC) as part of a broader “government efficiency” plan. The bill’s passed the House, and if the Senate gives it a thumbs-up, FREC could be gone by July 1. That’s the body that educates and regulates agents—so, yeah, kind of a big deal.

Whether either of these moves actually happens is TBD, but the message is clear: states are starting to flex hard on real estate regulation. Buckle up.
